Terms of Use

1. What these terms cover

These terms cover the Site only. Any services we perform for you (web development, systems administration, infrastructure or consulting work) are governed by a separate written quote and agreement signed or accepted by both of us. If that agreement conflicts with these terms, the agreement controls.

2. Information on the Site

The Site describes our services and past work for general information. It is not professional advice for your particular situation, and it is not an offer to provide services on any specific terms. Nothing on the Site is a price or a binding commitment. Every engagement begins with a fixed quote in writing, and only that written quote and agreement bind either of us.

We try to keep the Site accurate and current, but we do not promise that every detail is complete or up to date.

3. Using the Site

You agree not to:

• use the Site for anything unlawful, or to send spam, malware or abusive content through the contact form;
• try to gain unauthorized access to the Site, its hosting, or any system connected to it;
• probe, scan or test the vulnerability of the Site or our systems without our written permission;
• interfere with the Site’s operation, including by overloading it or bypassing rate limits; or
• use automated tools to scrape the Site in a way that burdens it.

If you believe you have found a security issue, please report it to contact@halfservers.com. We appreciate good faith reports.

4. What you send us

You are responsible for the information you send through the contact form, by email or on Discord, and you confirm you have the right to share it. Please do not send passwords, access keys or other credentials this way. Our Privacy Policy explains how we handle what you send.

If you send us ideas or feedback about the Site or our services, we may use them without owing you anything. This does not apply to your business information or to materials covered by an agreement with us.

5. Our content

The Site’s text, design, logo and graphics belong to Halfservers or are used with permission. You may view and share links to the Site, and print pages for your own reference. You may not copy, modify or republish our content for commercial purposes without our written permission. The names and marks of projects and companies shown in our portfolio belong to their respective owners.

6. Other websites

The Site links to websites we do not control, such as GitHub, LinkedIn, Discord and the sites of projects in our portfolio. We are not responsible for their content or practices, and their own terms and privacy policies apply when you use them.

7. Disclaimer

The Site is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will always be available or free of errors.

8. Limitation of liability

To the fullest extent the law allows, Halfservers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or business, arising from your use of the Site. Our total liability for any claim arising from the Site is limited to one hundred US dollars (USD 100). This section applies to the Site only; liability for services is set by the agreement for those services.

9. Governing law

These terms are governed by the laws of the State of Nebraska, without regard to its conflict of law rules. Any dispute about the Site will be brought in the state or federal courts located in Lancaster County, Nebraska, and you and we consent to their jurisdiction.

10. Changes

We may update these terms from time to time. The updated version applies from the effective date shown at the top. Continuing to use the Site after a change means you accept the updated terms.
